President Felipe Calderon gave a shot in the arm to the tequila industry by paying a visit last week to the Regional Tequila Council (CRT) offices in Guadalajara to show his support for one of Mexico’s most emblematic sectors. Primarily, Calderon pledged to continue protecting and promoting tequila’s denomination of origin status, which gives international recognition to the liquor as a distinctive product distilled from the fermented juice of the blue agave plant in certain regions of Mexico.

Calderon patted his administration on the back for finally persuading both China and South Korea to subscribe to the agreement that prevents the word tequila from being used as a generic name on other spirits not made under the controls of the CRT.

Mexico also reached an agreement with China over its long-time refusal to accept 100 percent agave imports because its menthol content was higher than the country’s accepted norms.

The CRT recently opened an office in Shanghai and expects exports, led chiefly by Jose Cuervo, La Cofradia and Sauza, to soar in China in the near future.

Calderon also reiterated his support in fighting the illegal production of pseudo tequilas. According to the president, during his administration police have revised 11,000 properties where illegal production has been suspected and detained over 2,000 people.

The tequila industry supports around 38,000 families in 181 municipalities, chiefly in Jalisco, but also in the states of Guanajuato, Michoacan, Nayarit and Tamaulipas.

A federal judge on Friday issued an injunction preventing a rival liquor company from using a dripping wax seal on its tequilas sold in the United States, ending a seven year legal battle over the bottle topper.

The dripping red wax seal on a bottle of Maker’s Mark is not only distinctive, it’s now exclusive legal property of the bourbon company.

A federal judge on Friday issued an injunction preventing a rival liquor company from using a dripping wax seal on its tequilas sold in the United States, ending a seven year legal battle over the bottle topper.

The ruling by U.S. District Judge John G. Heyburn II comes in a long-running lawsuit between Maker’s Mark and competitors Diageo North America and Casa Cuervo over the Fortune Brands trademark on the wax seal. Deerfield, Ill.-based Fortune Brands owns Maker’s Mark.

“The Court considers the red dripping wax seal inherently distinctive, because it is a unique mark used in an unusual way to draw in the consumer,” Heyburn wrote.

Mexico-based Cuervo used a dripping red wax seal on special bottles of its Reserva tequila, which was distributed by London-based Diageo.

Heyburn’s ruling barred the companies from using the seal, but did not award damages to Maker’s Mark.

Calls and e-mails to spokesmen for Maker’s Mark, Diageo and Cuervo were not immediately returned Friday.

The Samuels family, which created Maker’s Mark, in 1958, trademarked the distinctive seal, which serves only a decorative purpose.

Cuervo opted to include a dripping wax seal on bottles in 1997 as part of an effort to create an artisan look. The bottles of Reserva with the new seal entered the U.S. market in 2001 in a limited production of 3,000-to-4,000 bottles. The bottles remained on sale in the U.S. for about three years.

Maker’s Mark, bottled in Loretto in central Kentucky, sued over the seal in 2003, claiming it violated the long-standing trademark. Cuervo dropped the dripping wax seal five years ago.

During a six-day trial in Louisville last year, Casa Cuervo CEO Juan Domingo Beckmann testified that he made a business judgment to stop using the seal after being sued.

“I like the way it looks, and I would like to be able to use the dripping wax because it looks more hand-crafted,” Beckmann testified. “But if I am going to be sued over it, or if I have to pay in order to use it, I simply wouldn’t.”

Heyburn found that idea “laudable,” but not persuasive enough to forestall an injunction.

Maker’s Mark spends about $22 million annually to market its bourbon, and sells about 800,000 cases annually. The ad campaigns focus heavily on the dripping red wax seal. The company occasionally will make a wax seal of a different color, such as its recent promotion raising money for a charity with University of Kentucky basketball coach John Calipari. In that case, Maker’s Mark produced a limited number of bottles with a blue wax seal.

Along with the advertising campaigns, Maker’s Mark uses onsite dipping stations that allow customers to make their own wax seals on bottles, as well as bartender training.

“Because of the unique nature of the advertising’s focus on the red wax, the mark has in some ways taken on a life of its own, garnering significant attention beyond the purchased advertising,” Heyburn wrote. These efforts have cultivated something akin to a cult following of the brand among whisky enthusiasts.”

Heyburn declined to award damages, saying Cuervo violated the trademark, but did not focus its marketing efforts on the red wax seal to the point of damaging Maker’s Mark’s brand. Cuervo spent only about $500,000 of its $100 million overall branding budget on the Reserva tequila and sold its bottles for $100 each, while Maker’s Mark went for about $24 a bottle, Heyburn found.

“The price difference in products suggests that Reserva appeals to connoisseurs,” Heyburn wrote.

Maker's Mark Distillery, famous for the distinctive wax seal atop its Kentucky bourbon, is seeing red over what it considers a trademark infringement by some liquor competitors.

Maker’s Mark Distillery, famous for the distinctive wax seal atop its Kentucky bourbon, is seeing red over what it considers a trademark infringement by some liquor competitors.

In a federal lawsuit, Maker’s claims a red wax-like coating on bottles of the high-end Jose Cuervo Reserva de la Familia tequila amounts to an improper imitation of the bourbon producer’s seal.

The bourbon producer said the resemblance dilutes the unique quality of its seal and wants to drain the defendants of profits made from the packaging.

The suit filed this week in Louisville names Tequila Cuervo la Rojena and some affiliated companies as defendants, along with Diageo North America Inc., the U.S. distributor of the tequila.

Attorneys for the defendants declined comment Friday, saying they haven’t thoroughly reviewed the suit.

Maker’s — a part of Deerfield, Ill.-based Fortune Brands Inc. — said it has used its red wax seal continuously since 1958 and has made the well-known top a big part of its promotions.

“The red wax mark has acquired a tremendous commercial magnetism,” Maker’s said in its suit.

The bourbon producer said the red wax-like coating appearing on the Jose Cuervo Reserva tequila bottles deliberately resembles the Maker’s Mark seal. The suit said the resemblance is likely to cause confusion among consumers.

The suit seeks unspecified damages and payments representing profits made by the defendants through use of the disputed seal. Maker’s also seeks an order barring the defendants from using any coating that could be confused with its wax top.

It also seeks the destruction of any merchandise, labels, bottles, stationery and advertising in the defendants’ possession that represent the disputed packaging.

Maker’s lawsuit is similar to another filed by the bourbon producer in 2003 regarding the same high-end tequila. The first suit is scheduled for trial in November, though a pending motion by the defendants asks a judge to throw out the claims by Maker’s.

Edward Colbert, an attorney for Maker’s, said Friday that the second suit stems from changes made in the tequila product’s packaging since. He said the wax coating is still being applied, and that “it’s still very much the same, but somewhat different.”

The barman is charged with having “fatally injured” the boy in his bar in February 2007. The barman has admitted responsibility, German media report.

The 28-year-old barman, identified only as Aytac G, allegedly had a drinking bet with the schoolboy, but poured mostly water for himself.

The boy fell into a coma with alcohol poisoning, and died four weeks later.

The case triggered outrage in Germany and a heated debate about binge drinking by teenagers.

Two men aged 18 and 21, who encouraged the 16-year-old to down the tequilas, were sentenced in November to complete a compulsory social training course.

Prosecutors accuse the barman of having also served alcohol illegally to youths on 173 occasions in 2005-2007.
